Carrier’s right to sell goods

1) Carriers do not normally have a right to sell goods consigned via their services except where there is an ‘agency of necessity’ in which case three conditions have to be satisfied: the customer must have given consent for the carrier to have possession of the goods;

there must be a real emergency with, for example, perishable goods; and it must be impossible for the carrier to have been able to obtain the customer’s instructions regarding their disposal. The carrier must obtain the best possible price for the goods and pay over to the customer the proceeds of the sale less his expenses.
